STORE TERMS AND CONDITIONS

IMPORTANT – READ CAREFULLY: THESE STORE TERMS AND CONDITIONS GOVERN PURCHASES FROM AND USE OF THE CURIOSITY UNTAMED STORE.
The Curiosity Untamed Store is owned and operated by Curiosity Untamed LLC, a California limited liability company (“Curiosity Untamed,” “we,” “us,” or “our”). These Store Terms and Conditions (“Store Terms”) apply to purchases made through the Curiosity Untamed Store at shop.curiosityuntamed.com (the “Store”) and to use of the Store website.
By placing an order through the Store and affirmatively accepting these Store Terms at checkout, you (“Customer” or “you”) agree to be legally bound by these Store Terms and the policies incorporated into them by reference.
1. Relationship to the Main Curiosity Untamed Terms
These Store Terms govern retail purchases made through the Curiosity Untamed Store, including the purchase, payment, production, shipment, return, refund, and exchange of physical merchandise.
Memberships, Subscription services, curriculum licenses, program Content, and use of the Curiosity Untamed, Frontier Girls, and Quest Clubs programs are governed separately by the Curiosity Untamed LLC Terms and Conditions and Limited License Agreement (“Main TOS”) and any agreements or policies incorporated into the Main TOS.
Purchasing a product from the Store does not purchase or create a Membership, Subscription, curriculum license, Frontier Girls Troop Membership, Quest Club Membership, or other right to use Curiosity Untamed LLC’s protected Content or Trademarks except to the extent expressly stated in connection with the product.
If both these Store Terms and the Main TOS apply and there is a conflict between them, these Store Terms control with respect to the purchase, payment, production, shipment, return, refund, or exchange of Store products. The Main TOS controls with respect to Memberships, Subscriptions, curriculum licenses, program Content, Trademarks, and program use.
2. Eligibility and Orders
Customers must be at least 18 years old or have the involvement and permission of a parent or legal guardian to place an order through the Store.
By placing an order, you represent that the information you provide is accurate and complete and that you are authorized to use the payment method submitted with the order.
An order confirmation acknowledges that we received your order. It does not prevent us from cancelling or correcting an order when reasonably necessary, including because of product unavailability, an incorrect price or product description, suspected fraud, payment problems, shipping restrictions, or an error affecting the order.
If we cancel an order after payment has been collected, we will refund the amount paid for the cancelled portion of the order.
3. Products and Product Information
Curiosity Untamed makes reasonable efforts to accurately describe and display products offered through the Store. Actual colors, dimensions, appearance, or other characteristics may vary slightly from photographs or screen displays.
Many Store products are handmade, assembled, produced, or otherwise made to order. Minor variations that do not materially affect the product’s intended use are not considered defects.
Product availability may change without notice. We may discontinue products, modify products, or limit quantities at any time.
4. Prices, Payment, and Taxes
Prices are displayed in U.S. dollars unless otherwise stated and may change without notice. The price applicable to an order is the price displayed when the order is placed, except where correction is necessary because of an obvious pricing, typographical, or technical error.
Applicable shipping charges and taxes will be shown during checkout when they can be determined at that time.
Payment must be made using a payment method accepted by the Store. Payments may be processed by third-party payment processors. Curiosity Untamed LLC does not receive or store a Customer’s complete payment-card information when that information is handled directly by the payment processor.
5. Made-to-Order Badges
Badge pins and badge magnets are made to order. Most badge orders are made and ready to ship within approximately one week, although processing times vary depending on order volume and the time of year.
Because badge pins and magnets are made specifically in response to an order, they are not returnable or exchangeable except when an item arrives damaged, defective, or incorrect, or when a return or refund is otherwise required by law.
Customers are responsible for reviewing badge names, quantities, ring color, and other selections before submitting an order.
6. Branded Apparel and Gift Items
Certain branded apparel and gift items are made to order and fulfilled by a third-party fulfillment provider, including Printful. These products are produced and shipped directly by the fulfillment provider rather than from Curiosity Untamed LLC’s California location.
Because these items are made to order, branded apparel and gift items are not returnable or exchangeable for reasons such as ordering the wrong size, changing your mind, or no longer needing the item. Damaged, defective, or incorrect items will be handled in accordance with our Refunds & Returns Policy and applicable law.
Orders containing both products shipped by Curiosity Untamed LLC and products fulfilled by a third-party provider will arrive in separate packages and may include separate shipping charges because the products are shipped from different locations.
Production and delivery times for third-party fulfilled products are estimates. Curiosity Untamed LLC does not offer rush shipping for these products.
7. Processing and Shipping
Many products sold through the Store are made to order. Customers should allow time for both processing and shipping. We recommend placing orders at least three weeks before the products are needed, particularly for meetings, ceremonies, events, or other date-specific purposes.
Vests, accessories, and awards generally ship within seven days. Occasionally an item may be backordered, which may delay shipment by approximately two to three weeks.
When an item is backordered, we may offer the Customer the choice of having available items shipped immediately and the backordered items shipped separately when available, or having the entire order held until all items are available. There is no additional shipping charge when Curiosity Untamed LLC separately ships a backordered item.
Orders shipped directly by Curiosity Untamed LLC are sent through the United States Postal Service from Redding, California. Packages weighing less than 16 ounces are generally shipped using USPS Ground Advantage. Packages weighing 16 ounces or more are generally shipped using USPS Priority Flat Rate Mail .
Curiosity Untamed LLC does not offer overnight or express shipping.
Processing and shipping times are estimates unless Curiosity Untamed LLC expressly agrees in writing to a guaranteed shipment or delivery date. If you need an order by a particular date, you may include that date in the order notes and contact us at info@curiosityuntamed.com. We will make reasonable efforts to accommodate the request, but requested delivery dates are not guaranteed.
If we are unable to ship merchandise within a time required by applicable law or within a shipment time we have expressly promised, we will provide any notice, cancellation option, consent-to-delay opportunity, or refund required by applicable law.

8. Shipping Destinations
The Curiosity Untamed Store currently ships to addresses within the United States and Canada only. We do not ship to other international destinations.
Shipping charges to Canada displayed at checkout may be estimates. Once an order has been processed, packed, and weighed, the actual shipping cost can be determined. If a Customer has overpaid for shipping, the difference will be refunded. If the actual shipping cost is higher than the amount paid, we may contact the Customer for the additional amount before shipping the order.
Curiosity Untamed LLC does not collect or pay Canadian GST/HST, customs duties, tariffs, import fees, or other charges imposed upon importation unless those charges are specifically collected during checkout. The Customer is responsible for any additional taxes, duties, tariffs, brokerage charges, or other import-related fees assessed on the order.
Delivery times to Canada may vary because of customs processing and other circumstances outside our control. Delivery dates to Canada are not guaranteed.
9. Returns, Exchanges, and Refunds
Eligible vests, lapel pins, patches, tabs, and ribbons may be returned or exchanged within 30 days after delivery if they are new, unused, and in their original condition.
Badge pins and magnets are made to order and are not returnable or exchangeable except when damaged, defective, or incorrect, or when required by law. Branded apparel and gift items that are made to order are likewise not returnable or exchangeable except when damaged, defective, or incorrect, or when required by law.
Clearance merchandise is final sale and cannot be returned or exchanged except where required by law.
For ordinary eligible returns or exchanges, the Customer is responsible for return shipping costs. Original shipping charges are not refundable unless required by law or unless the return results from our error. When an exchange requires a replacement item to be shipped, the Customer is responsible for applicable shipping costs unless the exchange is necessary because the original item was damaged, defective, or incorrect.
Approved refunds are issued to the original payment method. After a refund is processed, it may take approximately 5–10 business days to appear in the Customer’s account depending on the financial institution or payment provider.
The foregoing return restrictions do not limit any right to a refund, cancellation, replacement, or other remedy that cannot lawfully be waived.

10. Damaged, Defective, or Incorrect Items
Customers should contact Curiosity Untamed LLC promptly if an order arrives damaged, defective, or contains an item different from what was ordered.
When Curiosity Untamed LLC or its fulfillment provider is responsible for a damaged, defective, or incorrect product, we will provide an appropriate replacement, refund, or other remedy. The Customer will not be required to pay additional shipping charges to correct an error for which Curiosity Untamed LLC or its fulfillment provider is responsible.
We may request photographs or other reasonable information necessary to verify the problem and determine the appropriate resolution.
Missing Items. Customers are responsible for checking the contents of their order after delivery. If an item is missing from a delivered package, the Customer must notify Curiosity Untamed LLC within thirty (30) days after delivery. Claims for items reported missing more than 30 days after delivery may be denied because Curiosity Untamed LLC may no longer be able to verify the contents of the shipment. This reporting period does not apply to merchandise that Curiosity Untamed LLC’s records show was never shipped and does not limit any rights or remedies required by applicable law.
11. Lost, Delayed, and Undeliverable Packages
Curiosity Untamed LLC is not responsible for delays caused by the shipping carrier, customs processing, weather, natural disasters, incorrect or incomplete addresses supplied by the Customer, or other circumstances outside our reasonable control, except to the extent responsibility is imposed by applicable law.
Customers are responsible for providing a complete and accurate shipping address. If an order is returned to us because the Customer supplied an incorrect or incomplete address, additional shipping charges may apply before the order is reshipped.
Nothing in this section limits a Customer’s rights concerning merchandise that is not delivered when those rights are provided by applicable law or the Customer’s payment provider.
12. Intellectual Property
The Store and its contents, including product designs, badge designs, photographs, graphics, logos, text, trade names, Trademarks, and other materials, are owned by, licensed to, or otherwise lawfully used by Curiosity Untamed LLC and are protected by applicable intellectual-property laws.
Curiosity Untamed, Frontier Girls, Quest Clubs, their associated logos and branding, and other protected marks may not be reproduced or used without authorization.
Purchase of physical merchandise does not transfer ownership of any copyright, trademark, badge design, curriculum, or other intellectual-property right and does not grant permission to manufacture, reproduce, copy, distribute, or sell the purchased product or its design.
Any rights associated with participation in Curiosity Untamed, Frontier Girls, or Quest Clubs are governed by the applicable Membership, Subscription, license, Main TOS, and related agreements rather than by the purchase of Store merchandise.
13. Acceptable Use of the Store
Customers and other users may use the Store only for lawful purposes. Users may not interfere with the operation or security of the Store; attempt to gain unauthorized access to accounts, systems, or data; introduce malicious software or code; scrape or collect Store data through unauthorized means; impersonate another person or entity; use the Store for fraudulent activity; or infringe Curiosity Untamed LLC’s or another party’s intellectual-property or other legal rights.
We may restrict or terminate access to the Store when reasonably necessary to protect the Store, Curiosity Untamed LLC, our customers, or other parties from unlawful, fraudulent, abusive, or harmful activity.
14. Third-Party Services and Websites
The Store may use or link to services operated by third parties, including payment processors, shipping carriers, fulfillment providers, and other service providers.
Use of a third-party service may also be subject to that provider’s own terms and privacy practices. Curiosity Untamed LLC does not control independent third-party websites or services and is not responsible for their content, availability, security, or privacy practices except to the extent responsibility cannot lawfully be excluded.
15. Privacy
Information collected through the Store is handled in accordance with the Curiosity Untamed Store Privacy Policy, which is incorporated into these Store Terms by reference.
The Store Privacy Policy explains the categories of information collected, how information is used, the types of service providers with whom information may be shared, applicable retention practices, and the choices and rights available to Customers.
16. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Store and Store website are provided on an “as-is” and “as-available” basis.
Curiosity Untamed LLC makes reasonable efforts to provide accurate product information and to fulfill orders properly but does not warrant that the Store will operate without interruption or error or that all product descriptions, photographs, or other Store content will be free from inadvertent errors.
TO THE FULLEST EXTENT PERMITTED BY LAW, CURIOSITY UNTAMED LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT FOR WARRANTIES THAT CANNOT LAWFULLY BE DISCLAIMED.
Nothing in these Store Terms eliminates or limits any warranty, remedy, or consumer right that cannot lawfully be waived.
17. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CURIOSITY UNTAMED LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR SPECIAL, INDIRECT, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR INCIDENTAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO USE OF THE STORE OR A PURCHASE FROM THE STORE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF CURIOSITY UNTAMED LLC ARISING OUT OF OR RELATING TO A STORE PURCHASE SHALL NOT EXCEED THE AMOUNT PAID BY THE CUSTOMER FOR THE ORDER GIVING RISE TO THE CLAIM.
These limitations do not apply to Curiosity Untamed LLC’s gross negligence or willful misconduct or to the extent a limitation is prohibited by applicable law.
18. Indemnification
To the fullest extent permitted by law, a Customer who uses the Store unlawfully, violates these Store Terms, infringes another party’s rights, or misuses Curiosity Untamed LLC’s intellectual property agrees to indemnify and hold harmless Curiosity Untamed LLC and its affiliates, officers, directors, employees, agents, and representatives from claims, losses, liabilities, damages, and reasonable costs arising from that conduct.
This provision does not require a consumer to indemnify Curiosity Untamed LLC for Curiosity Untamed LLC’s own gross negligence or willful misconduct and does not apply to the extent prohibited by applicable law.
19. Changes to These Store Terms
Curiosity Untamed LLC may modify these Store Terms from time to time.
The Store Terms in effect when an order is placed will generally govern that order. Changes made after an order is placed will not retroactively alter the material terms of that completed transaction unless required by law or agreed to by the Customer.
Revised Store Terms may apply to future use of the Store and future purchases after their effective date. The date of the most recent revision will be posted at the top of this page.
20. Governing Law
These Store Terms and the rights and obligations arising from them are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent applicable federal law or another law that cannot validly be waived or displaced applies.
21. Dispute Resolution; Arbitration; Class Action Waiver
If a dispute arises concerning a Store purchase or these Store Terms, the Customer shall first contact Curiosity Untamed LLC Customer Support at 1-530-524-8799 or info@curiosityuntamed.com and make a good-faith effort to resolve the dispute informally.
For a Customer who has affirmatively accepted these Store Terms, any dispute arising out of or relating to these Store Terms or a Store purchase that is not resolved informally shall be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) under the AAA rules applicable to the dispute. The location and manner of any hearing shall be determined in accordance with the applicable AAA rules. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
To the fullest extent permitted by applicable law, arbitration shall proceed on an individual basis only and not as a class or consolidated action. The Customer waives the right to participate in class arbitration or a class action with respect to disputes subject to arbitration. By agreeing to arbitration, Curiosity Untamed LLC and the Customer understand that disputes subject to arbitration will be decided by an arbitrator rather than by a judge or jury.
Nothing in this section eliminates any right or remedy that applicable law does not permit a consumer to waive.
22. Severability
If any provision of these Store Terms is found to be prohibited, invalid, or unenforceable in a particular jurisdiction, that provision will be ineffective in that jurisdiction only to the extent necessary, without invalidating the remaining provisions.
23. No Waiver
Curiosity Untamed LLC’s failure or delay in enforcing a provision of these Store Terms does not waive its right to enforce that provision later.
24. Entire Agreement and Incorporated Policies
These Store Terms, together with the Store Privacy Policy, Shipping & Order Processing Policy, Refunds & Returns Policy, and any other Store policy expressly incorporated into these Store Terms, constitute the agreement between Curiosity Untamed LLC and the Customer concerning Store purchases.
The Main TOS and its incorporated agreements and policies continue to govern Memberships, Subscriptions, curriculum licenses, program Content, Trademarks, and other matters within their scope as described in Section 1 of these Store Terms.
If a Store policy expressly addresses a specific matter differently from these Store Terms, the specific Store policy controls with respect to that matter unless these Store Terms expressly state otherwise.
